Personal Data Protection Law is a branch of law that includes legal regulations regarding the processing, storage and protection of individuals' personal data. This branch of law was developed to prevent the misuse of personal data and to protect the privacy of individuals.
In Turkey, Personal Data Protection Law is regulated by the Personal Data Protection Law No. 6698 (KVKK), which entered into force on April 7, 2016. This law sets out the basic principles to be followed in the processing of personal data and defines the obligations of data controllers.
According to the LPPD, personal data refers to any information relating to an identified or identifiable natural person. The Law imposes a number of obligations on data controllers to ensure that data processing activities are carried out in accordance with the law:
Disclosure Obligation: Data controllers must inform data subjects when collecting personal data.
Data Security: Necessary technical and administrative measures must be taken to ensure that personal data are stored securely and protected against unauthorized access.
Data Processing Terms: Personal data must be processed for specific, explicit and legitimate purposes.
Rights of the Data Subject: Data subjects have various rights such as learning whether their data is processed or not, requesting information if it has been processed, and requesting correction or deletion of the data.
While the Personal Data Protection Law ensures that the privacy of individuals is respected, it also requires data controllers to act transparently and responsibly when collecting and processing data. In this way, it is aimed to prevent the misuse of personal data and to increase data security awareness in society.
